Terms of Service

By creating an account or using BinnacleHarbor (the Service), you agree to these Terms on behalf of yourself and the organization you represent. If you do not agree, do not use the Service.

BinnacleHarbor is operated by Bluewave Projects, Hawaiʻi, USA (we, us).

BinnacleHarbor provides marina operators with tools to manage slip assignments, vessel check-ins, billing records, and harbor communications. We grant you a limited, non-exclusive, non-transferable license to use the Service for your marina's internal operations.

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You may not share login credentials across multiple marina organizations.
• We may suspend or terminate accounts for misuse, non-payment, or violation of these Terms.

You agree to use BinnacleHarbor only for lawful marina management purposes. You must not:

• Enter false vessel or captain information
• Use the weather notification feature to send spam or marketing email unrelated to harbor operations
• Attempt to reverse-engineer, scrape, or interfere with the Service
• Resell or sublicense access to the Service

You are responsible for obtaining any necessary consent from captains and vessel operators whose personal data (name, email, phone) you enter into BinnacleHarbor. We process that data on your behalf as a data processor under your instruction.

Do not enter data for individuals who have requested deletion of their records. Handle data-subject requests (access, correction, deletion) in accordance with applicable law and notify us if you need our assistance.

The weather alert feature allows you to send bulk email to captains currently checked into your marina. By using this feature you agree to:

• Send only legitimate harbor operational communications (weather, safety, closures)
• Include your marina's name and physical address in each email
• Honor any captain's request to be excluded from future alerts
• Comply with the US CAN-SPAM Act and any other applicable anti-spam laws

Paid plans are billed monthly or annually in advance. Fees are non-refundable except as required by law or as described in our refund policy. Prices may change with 30 days' notice. Payments are processed by Stripe — we do not store card numbers.

We target 99.5% monthly uptime. Scheduled maintenance will be announced in advance where possible. BinnacleHarbor is provided “as is” without warranty of fitness for a particular purpose. We are not liable for losses arising from downtime, data errors, or decisions made using the Service.

BinnacleHarbor and its codebase, design, and content are owned by Bluewave Projects. You retain ownership of the data you enter (vessel records, billing data). You grant us a limited license to store and process that data to provide the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of your use of the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Either party may terminate at any time. Upon termination, your access will be revoked and your data will be deleted within 30 days, unless retention is required by law. You may export your data at any time before termination.

These Terms are governed by the laws of the State of Hawaiʻi, USA. Disputes will be resolved in the courts of Honolulu County, Hawaiʻi, unless otherwise required by law.

We may update these Terms with 14 days' notice via email or in-app notification. Continued use after the effective date constitutes acceptance.
